Overview

Welcome to Avesso. The terms "we", "us" and "our" refer to Avesso. Avesso operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Avesso is powered by Shopify, which enables us to provide the Services to you.

The terms and conditions below, together with any policies referenced here (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as conformity, liability and your statutory right of withdrawal.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

Nothing in these Terms affects your mandatory rights as a consumer under Dutch and EU law. Where any provision of these Terms conflicts with those rights, your statutory rights prevail.

Section 1 — Access and account

By agreeing to these Terms of Service, you confirm that you are at least 18 years old, or the age of majority in your country of residence.

To use the Services, including browsing our store or purchasing any of the products we offer, you may be asked to provide certain information, such as your email address and your billing, payment and shipping details. You confirm that all the information you provide is correct, current and complete, and that you have the right to provide it.

If you create an account, you are responsible for keeping your account credentials secure and for the activity that takes place under your account. You may not transfer, sell, assign or license your account to anyone else.

Section 2 — Our products

Avesso sells curated second-hand menswear. Every item has been worn before, and we describe its condition honestly using our condition grading. Signs of prior wear consistent with a garment's age and stated grade are part of what a second-hand piece is, and do not make it faulty.

We make every effort to represent our products accurately. Colours and appearance may differ slightly from how they appear on your screen, depending on your device and its settings.

Product descriptions may change at any time. We may discontinue any product and may limit the quantities of any product we offer to any person or region.

Selling second-hand goods does not affect your statutory right to receive goods that match their description and the condition stated at the point of sale. See Section 16 for how the legal guarantee of conformity applies.

Section 3 — Orders

When you place an order, you are making an offer to purchase. Avesso may accept or decline your order at its discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before an order is accepted. Please review your order carefully before submitting it.

If we are unable to accept, change or cancel an order, we will try to contact you using the email, billing address or phone number provided at the time of the order.

Your purchases are subject to return, exchange and your right of withdrawal in accordance with our Refund Policy.

Your purchases are for your own personal use and not for commercial resale.

Section 4 — Prices and billing

All prices are shown in euros and include any applicable taxes. Because we sell second-hand goods, VAT is generally accounted for under the margin scheme and is not stated separately. Shipping costs, where they apply, are shown separately at checkout before you confirm your order.

Prices, discounts and promotions may change without notice. The price that applies to your order is the price in effect at the time you place it, as set out in your order confirmation email.

We may run promotions from time to time that are governed by their own terms. Where a promotion's terms conflict with these Terms, the promotion's terms apply to that promotion.

You agree to provide current, complete and accurate payment and account information for all purchases, and to keep it up to date so that we can complete your transactions and contact you when needed. You confirm that you are authorised to use the payment method you provide.

Section 5 — Shipping and delivery

All delivery times are estimates. We are not responsible for delays caused by the carrier, customs, or other events outside our reasonable control, and we will keep you informed if we become aware of a delay.

Unless we agree otherwise with you, we will deliver your order within 30 days of accepting it. Risk in the goods passes to you when you, or someone you have nominated, take physical possession of them on delivery.

Section 6 — Intellectual property

Our Services, including all trademarks, brand elements, text, displays, images, graphics, video and audio, and the design, selection and arrangement of them, are owned by Avesso, its affiliates or its licensors and are protected by Dutch, EU and international intellectual property law.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any of the material on the Services without our prior written consent. Except as expressly set out here, nothing in these Terms grants you any licence or rights under any intellectual property of Avesso, Shopify or any third party. All rights not expressly granted are reserved by Avesso.

Avesso's name, logo, product and service names, designs and slogans are trademarks of Avesso or its affiliates or licensors, and you must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos and marks on the Services are the trademarks of their respective owners.

Section 7 — Optional tools

You may be given access to third-party tools as part of the Services, which we neither monitor nor control.

You acknowledge that we provide access to such tools "as is" and "as available", without warranties of any kind and without endorsement, and that we have no liability arising from your use of optional third-party tools. Any use of these tools is at your own risk, and you should make sure you are familiar with, and approve of, the terms on which the relevant third party provides them.

We may offer new features through the Services in future. These also form part of the Services and are subject to these Terms of Service.

Section 8 — Third-party links

The Services may contain materials and links to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites. If you choose to leave the Services to access them, you do so at your own risk.

We are not liable for any harm related to your use of third-party websites or your purchase of any products or services from them. Please review the relevant third party's policies before you engage in any transaction with them, and direct any complaints about third-party products or services to that third party.

Section 9 — Relationship with Shopify

Avesso is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Avesso. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Avesso, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Avesso.

Section 10 — Privacy

All personal information we collect through the Services is handled in accordance with our Privacy Policy, and certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify and other processors, which may be located in countries other than your own, in order to provide the Services to you. We handle all personal data in line with the General Data Protection Regulation (GDPR / AVG). See our Privacy Policy for full details.

Section 11 — Feedback

If you submit any ideas, suggestions, feedback, reviews or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including commercial use, to operate, improve and promote the Services.

You confirm that: (i) you own or have all necessary rights to your Feedback; (ii) you have disclosed any compensation or incentive received in connection with it; and (iii) your Feedback complies with these Terms. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.

We may, but are not obliged to, monitor, edit or remove Feedback that we consider unlawful, offensive, defamatory, obscene or otherwise objectionable, or that infringes any party's rights or these Terms.

You agree that your Feedback will not infringe any third party's rights, will not be unlawful, abusive or obscene, and will not contain any malware. You may not use a false email address, impersonate anyone, or mislead us about the origin of any Feedback. You are solely responsible for any Feedback you provide.

Section 12 — Errors, inaccuracies and omissions

Occasionally the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery times or availability. We may correct any such errors and update the relevant information at any time without prior notice.

Where an order has already been accepted, we will only change or cancel it for a genuine and obvious error, and we will contact you first and refund any amount you have already paid for the affected item.

Section 13 — Prohibited uses

You may access and use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to breach any applicable law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, harm, defame or intimidate any person; (e) to transmit false or misleading information; (f) to use or re-use any material that does not comply with these Terms; (g) to send any unsolicited advertising or spam; (h) to impersonate any person or entity; or (i) to engage in any conduct that restricts anyone's use of the Services or that may harm Avesso, Shopify or other users.

You also agree not to: (a) upload or transmit any malware; (b) reproduce, duplicate, copy, extract, sell or resell any part of the Services; (c) collect or track the personal information of others; (d) spam, phish or pretext the Services; (e) use any robot, spider, scraper, AI tool or other automated means to access the Services; or (f) interfere with or circumvent the security features of the Services. We may suspend, disable or terminate your access if we determine that you have breached any part of these Terms.

Section 14 — Agents

14.1 This section ("Agent Terms") applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of, or using, a person's device without direct supervision.

14.2 No Agent may access, use or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with Section 14.4 below. No Agent may access, use or interact with the Services if we have requested that it refrain from doing so.

14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses and interacts with the Services.

14.4 Agents must: (i) in all HTTP/HTTPS requests, identify the request as coming from an Agent and disclose the Agent's name in the request's user agent string in the form "Agent/[agent name]"; (ii) not conceal or obfuscate that any access is from an Agent, including by mimicking human interaction patterns or by completing or circumventing CAPTCHAs or other measures intended to distinguish computers from humans; (iii) respond truthfully to any prompt seeking to determine whether an interaction comes from a human or a computer; and (iv) not circumvent any measure intended to block, limit or control how Agents access the Services.

Section 15 — Termination

We may terminate this agreement or your access to the Services in our discretion at any time, and you will remain liable for all amounts due up to and including the date of termination.

The following sections continue to apply after any termination: Intellectual property, Feedback, Termination, Disclaimer of warranties, Limitation of liability, Indemnification, Severability, Waiver and entire agreement, Assignment, Governing law, Privacy, and any other provisions that by their nature should survive.

Section 16 — Conformity and disclaimer

The information presented through the Services is provided for general information only. We do not warrant that the information on the Services is accurate, complete or current, and any reliance you place on it is at your own risk. To the extent permitted by law, we disclaim liability arising from reliance on such information.

To the extent permitted by law, the Services themselves are provided "as is" and "as available", and we do not guarantee that your use of them will be uninterrupted, timely, secure or error-free.

This does not affect the products you buy from us. As a consumer, you are entitled to receive goods that conform to the description and condition stated at the point of sale, in line with the legal guarantee of conformity under Dutch and EU law. Because our goods are second-hand, the condition we describe — including any noted wear or flaws — forms part of what you are agreeing to buy. If an item does not match its description or the stated condition, you are entitled to the statutory remedies (such as repair, replacement, a price reduction or a refund) and to exercise your right of withdrawal as set out in our Refund Policy [LINK].

Section 17 — Limitation of liability

To the fullest extent permitted by law, Avesso and its partners, directors, officers, employees, affiliates, agents, contractors, service providers and licensors (and those of Shopify and its affiliates) will not be liable for any indirect, incidental, special or consequential damages of any kind, including lost profits, lost revenue, lost savings or loss of data, arising from your use of the Services or any products bought through them.

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; our intent or gross negligence; or any other liability that cannot be excluded or limited under Dutch or EU law. Nothing in these Terms affects your statutory rights as a consumer.

Section 18 — Indemnification

You agree to indemnify and hold harmless Avesso, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, arising out of (1) your breach of these Terms or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services. This Section does not apply to ordinary use of the Services by a consumer acting in good faith.

Section 19 — Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforceable to the fullest extent permitted by law, the unenforceable part will be severed, and the remaining provisions will continue in full force and effect.

Section 20 — Waiver and entire agreement

Our failure to exercise or enforce any right or provision of these Terms is not a waiver of that right or provision.

These Terms of Service, together with any policies we post on this site, constitute the entire agreement between you and us regarding your use of the Services, superseding any prior agreements between us. This does not override any mandatory consumer protections that apply to you by law.

Section 21 — Assignment

You may not transfer or assign these Terms, or any of your rights or obligations under them, without our prior written consent, and any such attempt is void. We may transfer or assign these Terms and our rights and obligations, provided this does not reduce your rights under them.

Section 22 — Governing law and disputes

These Terms of Service, and any separate agreements under which we provide you Services, are governed by the laws of the Netherlands. Any disputes will be submitted to the competent court in Rotterdam, the Netherlands.

If you are a consumer, you also continue to benefit from any mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country where the law allows. The European Commission's Online Dispute Resolution platform is also available at https://ec.europa.eu/consumers/odr.

Section 23 — Headings

The headings in this agreement are for convenience only and do not affect the interpretation of these Terms.

Section 24 — Changes to these Terms

You can review the most current version of these Terms of Service at any time on this page. We may update or replace any part of these Terms by posting changes to our website, and we will notify you of any material changes in accordance with applicable law. Your continued use of the Services after changes take effect constitutes acceptance of those changes.
